Can I get disability and workers’ compensation at the same time?

Yes it is possible for a person to collect workers’ compensation and Social Security Disability Insurance benefits at the same. Those who are injured while working may qualify for workers’ comp and disability if they can establish the injury is related to work, and also meet the disability qualifications for SSDI.

However, there are limits to how much money one can receive from both workers’ comp and disability. Generally, the claimant cannot receive more than 80 percent of their earnings between SSDI and workers’ comp.

To calculate the offset, the SSA determines the applicable limit, or the maximum monthly amount of the benefits between the two systems that the recipient is allowed to get under federal law.

Certain states offset their worker’s comp claims to account for SSDI, in the same way that Social Security offsets SSDI to account for worker’s compensation. This is called a “reverse offset.” Fifteen states have some version of this rule.
